Terms of Use

These terms are an agreement between you and Silk Creative Labs LLC (“we”, “us”), the publisher of the Spellhunt app for iPhone and iPad (“Spellhunt”). By downloading or using Spellhunt you agree to them. If you do not agree, please do not use the app. Our Privacy Policy explains how we handle your information.

1. Your license

We give you a personal, non-exclusive, non-transferable, revocable license to use Spellhunt on Apple devices you own or control, as permitted by the Usage Rules in Apple’s Media Services Terms. You may not copy, modify, reverse engineer, resell or redistribute the app or its puzzles, or use bots, scripts or modified clients to play it.

2. Accounts and age

• You can play as a guest. Signing in with Apple keeps your progress in an account and is required for leagues and some social features.
• Leagues are only for players who are 13 or older. If you are under the age of majority where you live, a parent or guardian should review these terms with you.
• You are responsible for activity on your account. You can delete it at any time in the app (You tab → Delete account).

3. In-app purchases

• Spellhunt is free to download. It offers optional in-app purchases, such as coin packs, bundles, theme packs, a season pass and Remove Ads, and an optional subscription, Spellhunt Plus.
• All purchases are made through Apple and are governed by Apple’s terms. Prices are shown in the app in your local currency before you buy.
• Refunds are handled by Apple under its policies. You can request one at reportaproblem.apple.com. If Apple refunds a purchase, we may remove what it gave you.
• Items you buy once, such as Remove Ads or a theme pack, can be restored on any device signed in to the same Apple ID with “Restore purchases” in the Shop.

4. Spellhunt Plus subscription

Spellhunt Plus is an auto-renewing subscription, offered as a monthly or a yearly plan. The price and length of each plan are shown in the app before you subscribe.

• Payment is charged to your Apple ID account when you confirm the purchase.
• The subscription renews automatically unless it is cancelled at least 24 hours before the end of the current period. Your account is charged for renewal within the 24 hours before the current period ends, at the same price unless you were told otherwise in advance.
• You can manage and cancel your subscription in your Apple ID account settings after purchase (Settings → your name → Subscriptions). See Apple’s guide: Cancel a subscription from Apple. Cancelling stops the next renewal; you keep Plus until the end of the period you paid for.
• Free trial. Where a free trial is offered (for example, 7 days), it converts to a paid subscription at the end of the trial unless you cancel at least 24 hours before it ends. Any unused part of a free trial ends when you buy a subscription.
• Deleting the app or your Spellhunt account does not cancel a subscription.
• Plus benefits are described in the app and may change over time. If we remove a core benefit, it will apply from your next renewal and we will tell you in the app first.

5. Coins and other virtual items

• Coins, streak freezes, cosmetics and other in-game items are a limited license to use a feature of the game. They are not property, have no cash value, and cannot be exchanged for money, sold, transferred between accounts or refunded except as required by law or by Apple’s refund policy.
• We may change how items work, what they cost in coins, or how you earn them, to keep the game balanced.
• Items and coin balances are lost if you delete your account or if we close it for breaking these terms. Items bought with real money that Apple lets you restore can be restored.

6. Player names, custom puzzles and fair play

Some things you create are visible to other players: your player name, and custom puzzles and challenges you share. You keep ownership of what you create and give us a worldwide, royalty-free license to host, show and share it inside Spellhunt and through the links you share. Do not use a name, puzzle title or word list that:

• is offensive, hateful, sexually explicit, harassing or threatening;
• pretends to be another person, a brand, or Spellhunt staff;
• contains someone’s personal information, such as a full name, address or phone number;
• advertises something, or links to other services; or
• infringes someone else’s rights or breaks the law.

Play fair: no cheating, automation, exploiting bugs, or manipulating leagues, challenges or rewards. We screen names and puzzle words automatically, and players can report them. We may change or remove a name, hide or remove a puzzle, reset results, remove rewards, or suspend or close an account that breaks these rules. If you think we got it wrong, contact support.

7. Ads

The free version of Spellhunt shows ads from third parties. We are not responsible for the content of third-party ads or the sites they link to.

8. Changes to the app and these terms

Spellhunt is a live game. We may add, change or remove features, puzzles, events and leagues, and we may stop offering the app. We may update these terms; if a change is significant we will tell you in the app. Continuing to use Spellhunt after a change means you accept it.

9. Disclaimers and liability

Spellhunt is provided “as is” and “as available”. To the extent the law allows, we make no warranties, express or implied, including fitness for a particular purpose and non-infringement, and we do not promise the app will be uninterrupted or error-free. To the extent the law allows, we are not liable for indirect, incidental, special or consequential damages, or for loss of data, progress or virtual items, and our total liability to you is limited to the amount you paid for Spellhunt purchases in the 12 months before the claim. Nothing in these terms limits rights you have under consumer protection laws that cannot be waived.

10. Apple

These terms are between you and us, not Apple. Apple is not responsible for Spellhunt or its content, and has no obligation to provide maintenance or support for it. If Spellhunt fails to conform to an applicable warranty, you may notify Apple and Apple will refund the purchase price, if any; to the extent the law allows, Apple has no other warranty obligation. Apple is not responsible for any claims relating to Spellhunt, including product liability claims, claims that it fails to meet legal or regulatory requirements, consumer protection or privacy claims, or intellectual property infringement claims; we are responsible for those as these terms and the law provide. You confirm you are not located in a country subject to a U.S. government embargo or listed on a U.S. government list of prohibited parties. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

11. Governing law

These terms are governed by the laws of the United States and of the State of California, without regard to conflict-of-law rules. If you live in the European Union or the United Kingdom, you also keep the protection of the mandatory laws of your country, and you may bring claims in your local courts.
